Please read these Terms carefully. By using New Star Transport's services, you agree to be bound by these Terms of Service, which are governed by the laws of New South Wales, Australia. If you do not agree, please do not use our services. For questions, contact us at legal@newstartransport.com.au.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "you", "your") and New Star Transport Pty Ltd (ABN: XX XXX XXX XXX) ("New Star Transport", "we", "us", "our"), a transport and logistics company operating throughout Australia.

By booking any freight or logistics service with New Star Transport — whether online, by telephone, email, or in writing — you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional service-specific terms that apply to your booking.

These Terms are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising under these Terms.

2. Services

New Star Transport provides the following core transport and logistics services throughout Australia:

Refrigerated Transport: Temperature-controlled freight services maintaining specified temperature ranges (frozen, chilled, or ambient controlled) for perishable goods, pharmaceuticals, and other temperature-sensitive cargo.

Interstate Express: Express linehaul freight services connecting major Australian capital cities and regional centres, with guaranteed transit times on selected routes.

Country Express: Scheduled and on-demand delivery services to regional towns, rural properties, and remote communities across Australia.

Ancillary Services: Warehousing, freight consolidation, cross-docking, dangerous goods transport, oversized freight, and tail-lift delivery as arranged.

All services are subject to availability, geographic coverage, and freight acceptance policies. New Star Transport reserves the right to decline a booking at its discretion.

3. Booking and Acceptance of Freight

Booking Process: All bookings must be made through our authorised channels (website, phone, email, or API integration). A booking is confirmed only upon receipt of a booking confirmation from New Star Transport.

Accurate Information: You must provide accurate, complete, and truthful information about your freight at the time of booking, including correct weight, dimensions, nature of goods, temperature requirements, and any special handling needs. Providing false or inaccurate information may result in additional charges, delays, or refusal of carriage.

Dangerous Goods: The carriage of dangerous goods is subject to the Australian Dangerous Goods Code (ADG Code) and relevant state and federal legislation. You must declare all dangerous goods at the time of booking and ensure goods are packaged, labelled, and documented in full compliance with applicable regulations. New Star Transport reserves the right to refuse dangerous goods that do not meet these requirements.

Prohibited Items: We do not accept live animals, human remains, illegal substances, counterfeit goods, or any items prohibited by Australian law. A full list of prohibited items is available upon request.

Freight Packaging: You are responsible for ensuring all freight is adequately and appropriately packaged for road transport. New Star Transport is not liable for damage caused by inadequate or inappropriate packaging.

4. Charges and Payment

Quotations: All quotations provided by New Star Transport are estimates only and subject to change based on actual freight weight, dimensions, and any applicable surcharges. Final charges are based on actual or volumetric weight (whichever is greater) as measured at time of collection or at our facility.

Surcharges: Additional charges may apply for: fuel levies, remote area deliveries, after-hours pickups or deliveries, tail-lift services, dangerous goods handling, waiting time beyond 15 minutes, re-delivery attempts, and incorrect freight information.

Payment Terms: Account customers are subject to 30-day payment terms unless otherwise agreed in writing. All other customers are required to pay prior to or at time of booking. Overdue accounts may be subject to interest charges at the rate of 2% per month.

GST: All charges are exclusive of Goods and Services Tax (GST) unless otherwise stated. GST will be added to all applicable charges at the current rate of 10%.

Disputed Invoices: Any invoice disputes must be raised in writing within 14 days of the invoice date. Undisputed portions of invoices remain payable by the due date.

5. Transit Times and Delivery

Transit Times: Quoted transit times are estimates based on standard operating conditions and are not guaranteed unless a specific express or guaranteed delivery service is purchased. New Star Transport will not be liable for consequential losses arising from delayed delivery.

Force Majeure: New Star Transport will not be liable for delays caused by events beyond our reasonable control, including but not limited to extreme weather events, natural disasters, road closures, fuel shortages, industrial action, government restrictions, or pandemic-related disruptions.

Delivery Attempts: We will make one delivery attempt to the specified address. If delivery cannot be completed (no one present, access issues, incorrect address), the freight will be held at our nearest depot and you will be notified. Re-delivery will incur an additional charge. Unclaimed freight held for more than 14 days may be subject to storage charges.

Proof of Delivery (POD): A digital or physical proof of delivery will be provided for all consignments. POD is available via our online tracking portal within 24 hours of delivery.

6. Liability and Freight Insurance

Carrier Liability: New Star Transport's liability for loss, damage, or delay is limited in accordance with the Competition and Consumer Act 2010 (Cth), Australian Consumer Law, and the relevant state and federal freight legislation. Our liability for loss or damage to freight is limited to the lesser of: (a) the actual value of the goods; (b) the cost of repair or replacement; or (c) the amount specified in our current tariff schedule.

Exclusions: We are not liable for: loss or damage caused by inadequate packaging; inherent vice or natural deterioration of goods; goods that were not declared at time of booking; delay caused by force majeure events; consequential, indirect, or economic loss of any kind; or loss of data or information.

Declared Value Coverage: For additional protection, clients may declare the value of their goods at time of booking and pay the applicable declared value fee. This provides coverage up to the declared value for loss or damage caused by our negligence.

Cargo Insurance: We strongly recommend that all clients obtain comprehensive cargo insurance. New Star Transport can facilitate introductions to reputable cargo insurance providers upon request.

Refrigerated Freight: While we take all reasonable care to maintain specified temperatures, New Star Transport's liability for temperature-related loss is limited to situations where our equipment has demonstrably malfunctioned and the temperature deviation is confirmed by our monitoring data.

7. Chain of Responsibility

Under the Heavy Vehicle National Law (HVNL) and its Chain of Responsibility (CoR) provisions, all parties in the freight supply chain — including consignors, consignees, and freight forwarders — share responsibility for ensuring safe transport outcomes.

As a client of New Star Transport, you acknowledge your CoR obligations, which include:

  • Providing accurate freight information and adequate packing
  • Ensuring consignment documentation is correct and complete
  • Not applying unreasonable time pressure that may encourage unsafe driving practices
  • Ensuring loading and unloading facilities are safe and compliant
  • Promptly reporting any safety concerns to New Star Transport

New Star Transport will not carry out or procure the carrying out of transport activities in contravention of the HVNL or in a manner that poses an undue risk to public safety.

8. Temperature-Controlled Freight

Client Obligations for Refrigerated Freight: Clients engaging our refrigerated transport services must:

  • Provide accurate and complete temperature requirements at time of booking
  • Ensure goods are pre-cooled to the required temperature prior to collection
  • Use appropriate, food-grade or pharmaceutical-grade packaging as applicable
  • Provide compliant temperature data loggers for pharmaceutical consignments where required by TGA guidelines
  • Notify us immediately of any changes to temperature requirements

Temperature Deviations: In the event of a temperature deviation, our operations team will notify you as soon as reasonably practicable. You are responsible for making the disposition decision for affected goods. New Star Transport will provide full temperature records to assist your assessment.

HACCP and TGA Compliance: While New Star Transport maintains HACCP certification and TGA compliance for our operations, the client remains responsible for ensuring their products and packaging meet all applicable food safety and regulatory standards prior to handover.

9. Claims Process

Notification of Loss or Damage: Any claim for loss, damage, or shortage must be:

  • Noted on the delivery receipt at time of delivery (where damage is visible)
  • Reported to New Star Transport in writing within 3 business days of delivery for visible damage
  • Reported within 7 business days of the expected delivery date for concealed damage or non-delivery

Documentation Required: Claims must be supported by: the consignment note or booking reference; photographic evidence of damage; original invoices or proof of value; packing lists; and any relevant temperature data logs.

Claims Resolution: We aim to acknowledge all claims within 5 business days and resolve them within 30 business days, subject to the complexity of the claim and the need for investigation.

Failure to comply with notification timeframes may result in a reduced or declined claim. All claims are subject to our liability limitations as outlined in Section 6.

  • You breach any provision of these Terms
  • You fail to pay amounts owing within the agreed timeframes
  • We reasonably believe you are engaged in fraudulent or unlawful activity
  • You provide false or misleading information
  • You behave in an abusive or threatening manner toward our staff

Upon termination, all outstanding amounts become immediately due and payable. Termination does not affect any rights or obligations that accrued prior to the termination date.
